No snow? Big problem for US ski resorts

The lack of snow this year is creating big problems for ski resorts nationwide. NBC's Mike Taibbi reports.

By Elaine Porterfield, today.com contributor

Let it snow: words that skiers and employees of resorts around the country are fervently repeating as flakes resist falling on slopes from California to New England.

?It?s been a slow start for us,? said Ethan Austin, spokesman at Sugarloaf Mountain in Maine, the largest ski area east of the Rockies. The resort had little snowfall in December, so they?ve been relying on snow-making equipment to keep their slopes open, Austin said.

?Right now we don?t have a whole lot in terms of natural snow, around 25 to 30 inches,? he said. ?That?s quite a bit below average.? The resort currently has 28 trails open; 65 to 70 open trails is typical for this time of year.

Across the country, at Mammoth Mountain Ski Area in California, the snowmakers are on as well, said spokeswoman Joani Lynch. ?We are, safe to say, off to a slow start.?

It?s all the more painful for skiers spoiled by the 2010-2011 ski season?s bumper crop of snow, which broke records at some resorts. ?We have 1 to 2 feet right now, mostly man-made snow,? Lynch said. ?We had a very, very dry December -- just 2 inches. We got 200 inches last year just in December.?

The economic impact of low snowfall may not be significant for many destination resorts, because most, especially in the West, have invested heavily in snow-making machines that do a decent job, said Ralf Garrison, director and senior industry analyst at the Mountain Travel Research Program in Colorado. Most resorts have also worked at expanding non-slope activities such as dining and entertainment options, from spas to ice skating to nightlife, making it easier to entertain guests when snow is low.

?The economic salvation of the mountain resort industry is based on destination guests who travel from afar and make reservations significantly in advance,? Garrison said. ?If there?s an adequate man-made [snow] product, destination guests find that adequate.?

Michael Berry, president of the National Ski Areas Association, said that while many resorts are relying on man-made snow, ski areas in Arizona, New Mexico and southern California are doing well, which is almost an inversion of the normal pattern for this time of year. Ski areas in other parts of the country have had four or five years in a row of adequate to great snow, so most will be able to wait for a big dump or two to kick-start the slow beginning of this season, he said.

?This is not the first time nor will it be the last to have this happen,? Berry said. ?We?re a weather dependent industry.?

At Mount Bachelor in central Oregon, a storm forecast for mid-week and New Year's weekend is raising hopes the season might be turning around.

?With this storm coming through, we?re getting rain at bottom and snow at top and accumulating,? said Mount Bachelor marketing director Andy Goggins. ?That?s where we?re fortunate to have the tallest resort peak in the Cascades at 9,000 feet. We?re just crossing our fingers it will cool off more.?

Luckily, they?ve been able to maintain a consistent level of snow, Goggins said. ?We?ve had a 3-foot snowpack for the month of December and only lost a couple of inches. We have a lot of acres open.?

But it?s nothing like last season, he added wistfully: ?We got pretty spoiled last year with all the snow. At this date last year, we had a 77-inch base depth, compared to 32 inches now.?

The lack of a cold winter have hurt retailers trying to sell cold-weather apparel, reports CNBC's Courtney Reagan.

Economy gaining momentum, housing shows a pulse (Reuters)

WASHINGTON (Reuters) ? New U.S. claims for jobless benefits rose last week but the underlying trend pointed to an improving labor market, while regional factory data showed the economy gaining momentum as the year ended.

The growth picture was brightened by other data on Thursday showing pending sales of previously owned homes jumped to a 1-1/2 year high in November, adding to signs of a tentative recovery in the housing market.

Indications the economy was wrapping up the year on a much firmer footing than had been previously anticipated leaves it better positioned to deal with headwinds from the festering debt crisis in Europe and fiscal tightening at home.

"The data have maintained their stronger tone and that suggests the economy is on an upswing towards the end of 2011, but they are not pointing to robust growth in 2012," said Conrad DeQuadros, senior economist at RDQ Economics in New York.

Initial claims for state unemployment benefits rose 15,000 to a seasonally adjusted 381,000, the Labor Department said, above economists' expectations for 375,000.

But the four-week moving average, a better measure of labor market trends, dropped to a 3-1/2 year low.

A separate report showed the Institute for Supply Management-Chicago business barometer was little changed at 62.5 this month from 62.6 in November.

Economists had expected this measure of factory activity in the Midwest region, to fall to 61 in December. A reading above 50 indicates expansion in the region's manufacturing.

"It is possible that supply disruptions within the auto industry had a minor impact on the production component of the survey given the region's significant exposure to the sector," said Brett Ryan, an economist at Deutsche Bank Securities in New York.

"However, today's data highlight continued growth in manufacturing."

With new orders still strong; backlog orders, employment and supplier deliveries rising, the ISM-Chicago survey suggested a modest pickup in national factory activity from November.

The Institute for Supply Management will release its December survey of national manufacturing on Tuesday.

Other data showed the National Association of Realtors' Pending Home Sales Index, based on contracts signed in November, increased 7.3 percent to 100.1, the highest level since April 2010. Economists had expected only a 2 percent rise.

Pending sales lead existing home sales by a month or two.

Recent data on home sales and construction have been fairly upbeat, suggesting an improvement in a sector that has been the economy's weakest link, but prices continue to trend lower.

The economic data offset concerns about Europe and encouraged investors to buy U.S. stocks. Prices for U.S. Treasury debt rose, while the dollar was little changed against a basket of currencies.

LABOR MARKET HEALING

While much of the global economy is slowing and the troubles in Europe are expected to push the region into a mild recession in 2012, activity in the United States has held up relatively well.

Fourth-quarter growth is seen topping a 3 percent annual pace, rising from the July-September period's 1.8 percent rate.

"Unless things take a turn for the worse and we were to have a disorderly outcome in Europe, we wouldn't expect there to be a big impact on the U.S. given that U.S. exports to Europe are quite small as a share of the economy," said RDQ Economics' DeQuadros.

The euro zone crisis has seen banks tighten lending to major financial participants in recent months.

While the Federal Reserve's survey of senior credit officers did not mention Europe directly, it indicated a "broad but moderate tightening of credit terms applicable to important classes of counterparties over the past three months.

In the claims report, the improving labor market tone was captured by the four-week average, which held below the 400,000 mark usually associated with improving labor market conditions for seven straight weeks.

That left some economists anticipating nonfarm employment to increase by at least 150,000 in December, which would be a step-up from November's 120,000 gain.

The better tone should feed into consumer spending, which slowed significantly in November, and support economic growth.

Firming employment, marked by a drop in the jobless rate to a 2-1/2 year low of 8.6 percent in November, is helping to buoy consumer confidence.

"The jobs market is the backbone for consumers ... continued progress in the months ahead will be key to sustained improvement in the collective mood of consumers," said Jim Baird, chief investment strategist at Plante Moran Financial Advisors in Kalamazoo, Michigan.

Weak income growth is restraining consumer spending and households are meeting some of their pent-up demand by reducing savings.

Lakers give new coach his first win

Mike Brown can still coach. Kobe Bryant can still make his teammates better. Pau Gasol can still play tough.

The Lakers got some much-needed reassurances Tuesday night in a 96-71 victory over the Utah Jazz. Despite the fatigue of a third game in three days ? their only such stretch of this lockout-shortened season ? the Lakers took full advantage of Utah not being up to game speed in its season debut.

Kobe Bryant #24 of the Los Angeles Lakers controls the ball against Raja Bell #19 of the Utah Jazz at Staples Center on December 27, 2011 in Los Angeles, California.

The Jazz shot 28.2 percent from the field through three quarters against a Lakers defense still without center Andrew Bynum. The Lakers led, 71-46, entering the fourth quarter and soon enough sewed up Brown's first victory as Lakers coach.

Despite Bynum's second-to-last suspension absence, Jazz center Al Jefferson shot 2 for 16 from the field in his 24 minutes. Even so, his worst moment actually came on defense, when he fell so completely for Metta World Peace's 3-point fake that Jefferson was staring up at the rim, preparing to rebound, while World Peace steamed through the paint all alone for a rousing dunk.

Brown said about the Lakers' tremendous third-quarter rally in the Sunday opener against Chicago: "It was exciting to know what we're capable of." But this complete domination ? against a far less imposing opponent ? was a relief for the Lakers to know what they can still do.

After Brown talked pregame about the team being too reliant on Bryant to create offense Monday night in Sacramento, Bryant took just one shot in 10 first-quarter minutes ? making the 3-pointer ? as he got teammates involved. Bryant finished with 26 points, eight rebounds and five assists despite logging 35 and 38 minutes the past two nights with a torn wrist ligament.

The Lakers had lost their past eight games, counting the two sloppy exhibitions against the Clippers and the season-ending sweep to Dallas last postseason, so some feel-good vibes were welcomed. Even with lead in the 20-plus-point range, Gasol was pumping his fist after finishing through contact and Bryant was giving his he-can't-guard-me grin after being fouled by longtime rival Raja Bell.

Gasol, who didn't look strong often in the last postseason, had 22 points and nine rebounds despite his sprained right shoulder.

The Lakers avoided their fourth 0-3 start in franchise history (1978-79, 1960-61, 1957-58).

European, US markets eke out gains but Italy lags (AP)

PARIS ? Buoyant U.S. consumer confidence figures helped stock markets in Europe and on Wall Street eke out modest gains Tuesday in very light holiday trading but Italian shares dipped as the country's key borrowing rate ratcheted up to worrisome levels.

In the run-up to Christmas, investors have been cheered by a slew of upbeat U.S. economic indicators, particularly related to the crucial shopping season.

That continued Tuesday with the closely-watched survey into U.S. consumer confidence from the New York-based Conference Board. Its main Consumer Confidence Index rose almost 10 points to 64.5 from a revised 55.2 in November. That was above market expectations for a more modest rise to 60.

Though below the 90 level that indicates an economy on solid footing, the survey provided further evidence that the U.S. economy enjoyed a decent holiday shopping season. Economists watch the confidence numbers closely because consumer spending accounts for about 70 percent of U.S. economic activity.

"The consumer is sitting pretty in winter wonderland according to the Conference Board," said Andrew Wilkinson, an analyst at Miller Tabak & Co.

The figures helped cement the advance in markets in Europe and the U.S. and pushed oil prices back above $100 a barrel amid hopes of rising demand in the U.S.

In Europe, France's CAC-40 closed around a point higher at 3,103.11 while Germany's DAX was up 0.3 percent at 5,889.76. The FTSE index of Britain's leading shares remained closed.

On Wall Street, the Dow Jones industrial average was up 0.1 percent at 12,303 while the broader S&P 500 index rose by an equivalent rate to 1,267.

One market bucking the trend was Italy's FTSE MIB, which traded 1 percent lower as the yield on the country's ten-year bonds hovered around the 7 percent once again ? a level that is considered unsustainable in the long run and eventually forced Greece, Ireland and Portugal to seek outside financial help.

Italy is the eurozone's third-largest economy and is considered to be too big to save under current bailout facilities. Mario Monti, the country's new premier got parliamentary approval last week for a big austerity package that is intended to save the country from financial disaster. Markets have grown increasingly fearful over the past few months that Italy will find it difficult to pay off its massive debts, which stand at around euro1.9 trillion ($2.5 trillion).

Despite ongoing worries over the spread of Europe's debt crisis to Italy, the euro was trading 0.1 percent higher too at $1.3064.

However, analysts said the euro could face some choppy waters over the coming couple of days as Italy prepares for a couple of bond auctions on Wednesday and Thursday.

"The euro is little changed as markets look ahead to Italian government debt auctions later this week, which are likely to set the tone for the single currency and the wider foreign exchange market," said Vassili Serebriakov, a currency strategist at Wells Fargo Bank.

Markets took little notice of figures from the European Central Bank showing that Europe's banks parked a record euro411.8 billion ($538.2 billion) overnight at the bank on Monday.

Heavy use of the ECB's deposit facility has been a sign of distrust in interbank lending markets, as banks remain wary of lending to each other and prefer to hold it at low interest rates at the ECB. However, it can also rise and fall for technical reasons as banks adjust their liquidity requirements, especially in the run-up to the year-end.

The narrow ranges across stock markets reflect light holiday trading conditions. Markets in Europe and the U.S. were closed Monday and trading is expected to be light most of this week though there could be some year-end movements, particularly on Friday as investors look to lock in any gains they may have made.

Earlier in the day, Asian shares fell after a disappointing profit performance by Chinese companies and a warning that Japan faces "significant downside risks" due to Europe's debt problems. That warning came from a Finance Ministry representative at a November Bank of Japan meeting, the bank said Tuesday.

Tokyo lost 0.5 percent to 8,440.56 while Seoul's Kospi shed 0.8 percent to 1,842.02. Taipei, Singapore and Jakarta also declined. Hong Kong and Sydney were closed.

China's benchmark Shanghai index dropped nearly 1.1 percent to 2,166.21 after the country's government reported that profit growth slowed at its major industrial companies. Total profit in the January-November period rose 24.4 percent over a year earlier, down 0.9 percent from the growth rate for the first 10 months of the year.

Oil prices got a boost after the consumer confidence figures and benchmark crude for February delivery was up $1.22 to $100.90 per barrel in late morning trade in New York.

In Michigan, Decade Of Job Loss Is Finally Coming To End

Free Press:

Like a patient surviving a medical emergency, Michigan has the chance to learn some important lessons as it emerges from 10 straight years of job losses.

And like a patient learning to do push-ups and knee bends, Michigan must learn to become better educated and entrepreneurial in its business model as it recovers from this lost decade.

The state will add jobs in 2011 for the first time since 2000. The prolonged period of job losses tells many experts that even the state's core manufacturing industries require a more educated work force -- something the state may have trouble delivering.

Japan looking to buy Chinese government bonds (Reuters)

BEIJING (Reuters) ? Japan will seek to buy Chinese government bonds, the Japanese government said in a statement issued after Prime Minister Yoshihiko Noda held talks in Beijing with Chinese Premier Wen Jiabao on Sunday.

The statement given to reporters gave no details of when Japan might seek to buy the bonds or on what scale.

Japan had earlier indicated it is in talks to buy Chinese government debt to strengthen economic ties.

Despite sometimes rancorous political ties between the two neighbors, Japan's economic fortunes are increasingly tied to China's economic growth and consumer demand.

China has been Japan's biggest trading partner since 2009.

In 2010, trade between the two nations grew by 22.3 percent compared to levels in 2009, reaching 26.5 trillion yen ($339.3 billion), according to the Japan External Trade Organization.

China and Japan are also the world's first and second-biggest holders of foreign reserves.

Egyptian gas line to Israel blown up again

For the eleventh time this year, the gas line from Egypt to Israel and Jordan was blown up.

The company responsible for the line, GASCO, sent investigators out to see the extent of the damage. It also informed the Misr Insurance Corporation of the damage so it could be compensated.

Hmmm.

Earlier this week, Jordan and Egypt negotiated new pricing for the gas.

Nets' Lopez out 6-8 weeks after foot surgery (AP)

EAST RUTHERFORD, N.J. ? With the prospect of a trade for Dwight Howard fading and the season opener less than a week away, New Jersey Nets coach Avery Johnson was getting a feel for his team.

That all changed Thursday when center Brook Lopez broke his right foot, an injury that left Johnson shaking his head and considering his options.

Lopez, the Nets' leading scorer, had surgery Friday for a nondisplaced fracture. He was hurt in a preseason game against the Knicks on Wednesday and will be sidelined at least six weeks and probably more.

In the meantime, general manager Billy King acquired former All-Star center Mehmet Okur from Utah for a second-round draft pick, signed free agent guard DeShawn Stevenson and waived forward Ime Udoka.

With the additions of Okur and Stevenson, the Nets have hit the salary cap, so their revamped team is set.

It has one star, point guard Deron Williams, and a lot of new faces ? Okur, Stevenson, free agent forwards Shawne Williams and Sheldon Williams, rookies Marshon Brooks and forward Jordan Williams and holdovers Jordan Farmar, Anthony Morrow, Damion James and Kris Humphries.

"Every day is a new day I tell our players," Johnson said Friday. "When you get up in the morning you think about being a difference maker. You think about positive energy. Everybody is undefeated now."

The Nets (24-58) probably aren't going to stay that way long. They open on Monday at Washington and play 10 of their first 14 games on the road. The home opener is Tuesday against Atlanta.

"There is no surrender in how we react as coaches, how we approach practice," Johnson said. "It's not necessarily the situation we diagrammed going in, so we adjust. So if plan A doesn't work, you have to go to plan B and C and that's what we are doing."

The big question is Okur, who is to practice with the team Saturday.

"We needed another guy to fill in, but he's just not filling in," Johnson said. "He's a veteran player. He's had a solid career so far. He knows how to play and how to pass. He's still shooting the ball pretty good."

Okur played in 13 games last season while recovering from Achilles and back injuries. The 32-year-old Turk has averaged 13.7 points and 7.1 rebounds in 617 career games with Detroit and Utah.

Deron Williams played with Okur in Utah, and the two spoke Thursday.

"He was shocked a little bit at first, probably my reaction, but he's warming up to it and excited coming over, excited to play with me again," Deron Williams said. "I'll try to make the transition as easy as possible."

Deron Williams said the Nets would not have to revamp their offense because Lopez played more on the outside than in the paint.

"It's our team," Deron Williams said. "Whether I am comfortable or not, it's our team. We've got good guys, guys who know how to play basketball and make plays. That's all we need as long as our defense is locked in. Guys can hit shots, hit big shots, and I think we do. I like we added DeShawne. He can hit shots but he also brings that toughness and can guard people."

Johnson also is comfortable with his team, for now.

"I know they will play hard," Johnson said. "When you have a team with Deron Williams as the point guard he will do a good job of quarterbacking the team."

King expects Lopez to play in a game in six to eight weeks.

Dr. Martin O'Malley, a foot specialist, and team orthopedist Dr. Riley Williams III inserted a screw into the fifth metatarsal of Lopez's foot at the Hospital for Special Surgery in Manhattan. O'Malley said rehabilitation will start in two weeks.

Lopez averaged 20.4 points and 6.0 rebounds in 82 games last season.

"We go to him a lot late in games and stuff," Humphries said. "We won't have that. We'll probably have to play at a little different pace and be sharper with the shooting and be more up and down and precise in executing on the break. Depending on who plays his minutes, we'll be more of an up-tempo team."

Stevenson averaged 5.3 points and 1.2 assists in helping the Mavericks win their first title last season. He was used mostly in a defensive role and can score more if needed.

"It probably will be tough coming from the team where I came from, but at the same time it's a challenge," Stevenson said after his first practice with the Nets. "We were challenged to win a championship and this is a different type of challenge."

Democrats turn tables on GOP as Boehner relents on payroll-tax deal (The Christian Science Monitor)

Washington ? In a stunning reversal, House Speaker John Boehner late Thursday abandoned a bid to force Senate Democrats to the bargaining table to resolve an impasse over the expiring payroll tax cut ? a strategy that had risked tax hike for some 160 million American workers.

In the end, carrying on the fight was a losing proposition for a party that took back the House in 2011 on a pledge never to raise taxes. And ??? in a new development ??? Democrats learned to say, "No."

The deal marks a capitulation by the speaker, who appeared at the podium alone to announce the agreement, worked out with Senate majority leader Harry Reid (D) of Nevada and endorsed by President Obama.

RECOMMENDED: Why 'temporary' tax cuts never die: Payroll tax and 3 other examples

It also marks a breakthrough for Senate Democrats and Mr. Obama, who said "no" from the start of this impasse ? and stuck with it.

As a result, near empty chambers in the House and Senate on Friday will pass by unanimous consent a slightly modified version of a Senate bill that extends by two months the payroll-tax cut and other expiring measures, congressional leaders hope.

newslook

If the bill passes Friday, Obama will sign it before joining his family for vacation in Hawaii. If any member objects, the next step would be to call the full House or Senate back into session next week, when the measure is all but certain to pass.

This agreement means that the payroll tax cut, worth about $40 on the average paycheck, will remain in effect through February. Federal jobless benefits up to 99 weeks will also continue, and a proposed 27.4 percent payment cut for physicians serving Medicare patients will not take place on Jan. 1.

For five days, House Republicans struggled for traction to get the Senate to the negotiating table to take up the House version of that bill, which extended expiring provisions for a full year, and the so-called ?doc fix? by two years. But by midweek, they found themselves isolated and fighting alone.

In contrast with previous standoffs, this time the White House and Senate majority leader Harry Reid didn?t budge or even blink.

?Democrats learned to say, 'no,' and it worked for them,? says Stan Collender, a longtime federal budget analyst now with Qorvis Communications in Washington.

When Speaker Boehner on Thursday renewed calls for the Senate to appoint conferees to work out a one-year bill, Senator Reid declined. ?Once the House passes the Senate?s bipartisan compromise to hold middle-class families harmless while we work out our differences, I will be happy to restart the negotiating process to forge a year-long extension,? Reid said.

When Boehner rang up Obama, requesting that he send advisers to Capitol Hill to discuss flaws in the Senate plan, the president declined. ?Enough is enough,? he said at a rally with Americans concerned about a payroll tax hike. ?The people standing with me today can?t afford any more games.?

???The House needs to pass a short-term version of this compromise, and then we should negotiate an agreement as quickly as possible to extend the payroll-tax cut and unemployment insurance for the rest of 2012,??

In a final blow, Senate Republican leader Mitch McConnell on Thursday broke silence to urge Republicans to accept the Senate plan and for Democrats to name negotiators to an eventual conference over a one-year extension. That proposal became, in effect, the compromise that broke the impasse.

Up until this week, House Republicans, backed by a strong freshmen class stared down Senate Democrats and the Obama White House in one clash after another. With the new GOP House majority, the conversation on Capitol Hill shifted from stimulus spending to deficit cutting, from new green energy to fossil fuels. Deficit was cutting in. Tax hikes, including for the highest income taxpayers, was out.

The president tried to compromise with the new majority and Senate Democrats capitulated, dismaying elements of the Democratic base. Republicans won every encounter.

House Republicans threatened to shut down the government over unfinished spending bills for fiscal year 2011 ? a standoff that was settled after Democrats agreed to billions in spending cuts.

Boehner announced a new rule for raising the national debt limit ? that any hike in the debt ceiling must be accompanied by at least equal spending cuts ? and took the nation to the brink of a first-ever default on the national debt to hold that line. Negotiations between Boehner and Obama broke down after GOP conservatives rebelled at reports that the Speaker had agreed to $800 billion in revenue hikes.

Until now, House Republicans had stopped the Democratic agenda cold. Obama?s fiscal year 2012 budget and jobs program were blocked in the House, and his legacy from the last Congress ? health-care and Wall Street reforms ? placed under permanent siege.

But by late August, Democrats were weary of appearing rolled the by the tea-party wing of the House Republican caucus ? and heartened by signs that the public mood was turning against them.

The debt-ceiling debacle, which produced the first-ever downgrade of the US credit rating, battered the reputation of Congress, now at record low levels. It also battered public perception of the tea-party movement and of House Republicans, who were especially blamed for the brinkmanship in Congress.

?Our data shows that Americans want compromise in Washington more than sticking to principle,? says Frank Newport, editor of the Gallup Poll.

After the debt-ceiling crisis in August, ?We saw a big drop in several measures,? he adds. ?Economic confidence dropped nearly 20 points. Faith in Congress is so low now it?s discouraging in a democracy.? In a survey of the perceived honesty of various professions, Congress ranked dead last with lobbyists and car salesmen.

Boehner appeared to recognize that shift in public mood. In a two-hour conference call on Saturday, Boehner called the Senate bill to extend expiring measures a victory. But conservatives strongly objected. They called on Boehner to reject the Senate?s two-month extension and hold the line for the one-year House extension, including approval of the Keystone XL pipeline and a reduction of unemployment benefits from 99 to 59 weeks.

The House on Tuesday voted, 229 to 193, to reject the Senate bill and hold out for a new negotiation with the Senate over a one-year extension. But this time, Senate Democrats had resolved not to cave.

?Republicans and Democrats already negotiated an agreement and there is no time and no need to haggle over this any further,? says Sen. Charles Schumer (D) of New York in a conference call with reporters on Wednesday.

Even the editorial board of conservative-leaning The Wall Street Journal turned against them, dubbing GOP strategy over the expiring payroll-tax cuts ?a fiasco.? Provoking a crisis over an expiring tax cut affecting 160 million Americans was a tough sell. Most Americans supported extending the payroll-tax cut. By rejecting a Senate bill to extend those cuts, House Republicans, for the first time, appeared to be on the side of a tax hike.

Democrats saw the payroll tax clash as an opportunity to end a disappointing year on offense."It was opportunistic," says analyst Mr. Collender. ?Shortly after the debt-ceiling fight in August was the point at which 'no' for Democrats started to be an acceptable answer."

Until that point, Democrats were ?reflecting the president,? he adds. ?The president was trying to compromise, but each time they found that House Republicans kept raising the bar, and they were getting hurt with their base by appearing to be weak.?

But with the sharp turn in public-approval ratings after the debt-ceiling debacle, Democrats grew bolder in opposition and, in the end, left House GOP leaders no place to go but over a cliff.

?Support for Congress in general is close to its lowest point ever. Republicans are generally getting blamed for that, and support for the tea party is at its lowest point since the 2010 election. Put that together, and what?s the down side for Democrats in taking a strong position?? Collender adds.

LeapFrog LeapPad Explorer

My 7-year-old son has spent the last few months eyeballing the Apple iPad some family members have been sporting. It's not something I was actually considering getting him anytime soon. The good news is, I found something that he found just as entertaining: the LeapFrog LeapPad Explorer ($99.99 list). Aimed at the 4- to 9-year-old set, this device is meant to be not just a gaming and media consumption platform but also one for learning.

Design and Features
The LeapPad measures approximately 5.1 by 7 by 1 inches (HWD). The chassis is made of plastic in the LeapFrog signature colors of white and bright green (there is also a pink and white version). The 5-inch TFT touch screen has a resolution of 480 by 272, which is higher resolution than the 320-by-240 of the LeapFrog Leapster Explorer ($69.99 list). The whole device is rugged enough for typical wear and tear, and just the right size for children's hands.

The stylus can be stowed magnetically in a slot in the top right side of the LeapPad. While the magnet slot is a cool feature, I strongly recommend using the bundled second stylus with a string and attaching it to a small thin bar in a hollow right above the magnetic slot (we managed to lose the stylus without a string in a day). The location of the stylus slot is a vast improvement over its location on the Leapster Explorer, as both left- and right-handed users will not have a problem wielding the stylus even attached to the string.

The tiny power button lies on the left side of the screen. There's also a headphone jack at the top of the device, to the left of the game cartridge slot, and a mini-USB port next to the cartridge slot (a USB cable is bundled with the system). There is a small home button at the bottom right of the screen, which gets you back to the main menu, and the volume control is located to the right of the screen. In the middle of the area underneath the screen is a toggle button.

On the back of the LeapPad is a built-in camera and video recorder, and the device comes with 10 photo edit tools, as well as a countdown timer so users can take self-portraits. The LeapPad has an accelerometer, which allows users to move the device in various directions when playing games.

Leaplet Apps
Since it launched its Leaplet apps store, LeapFrog has added much to its inventory. Granted, it's not anywhere near as many apps as, say, the iTunes store, but at over 100, there's a lot to choose from. Among the highlights are what LeapFrog is calling Ultra ebooks (not to be confused with the new laptop category), a souped-up version of the ebooks that LeapFrog already had in its library. Where the ebooks had sound effects and a read-aloud feature, the ultra ebooks add games in the middle. For instance, the Cars 2 ultra ebook features a couple of cool racing games that take advantage of the built-in accelerometer.

In addition to games and e-books, there are also LeapFrog videos for purchasing and downloading to the Leapster. (I hope to see more videos available either in the store or on cartridges, if possible.) You have two options for purchasing an app from the Leaplet store. You can do so directly from LeapFrog's site, or you can buy a Leaplet app card, wait until you get it, then enter the download code. Once purchased, you can add the app, book, or movie to up to four Leapster Explorer and LeapPad devices, a boon to those who own several devices.

Performance
Setup was relatively easy. The system takes four double-A batteries, and installing them doesn't necessarily require a screwdriver. I used a quarter to slip open the two slots in the back of the unit, and voila, batteries installed. After inserting the batteries, I turned the unit on. I also created a player account for Jake (though this part was easy enough for Jake to have done himself). Then I inserted the bundled CD-ROM into my PC, and it brought me to LeapFrog's site (you'll need an Internet connection for this) where I downloaded the LeapFrog Connect app. Then I simply followed the instructions that came up on my computer screen.

After I connected, I added the device to my existing LeapFrog account (creating a new account is just as easy). It's important to note that if you have a previous LeapFrog account and set up a new account, you won't have access to apps you downloaded using your original account. (I found that out the hard way.) After the setup, I handed the LeapPad to Jake and sat back. Given that he already has the Leapster Explorer, it wasn't too hard for him to figure out the controls. The difference is that the physical controls?two control buttons (A and B), main menu, Hint button with a question-mark icon, and a Pause button?are now touch controls on the screen, but they're located more or less in the same place they were in the Leapster Explorer.

Jake had a lot of fun using his Leapster Explorer game cartridges ($24.99 list) on the LeapPad, such as Wolverine and the X-Men, a game that lets you customize over 12,000 words that the user can spell while reuniting the X-Men and saving mutant-kind, and Ben 10 Alien Force, which teaches concepts about animals, geography, and DNA.

Being an emerging comics fiend, Jake played the Wolverine game first. I thought the game creators did a clever job of weaving spelling exercises in with the gaming action. I actually thought he was oblivious to the learning that was going on with the gaming, until he said to me, "Mom, it's like the iPad, but with learning." That's my boy.

Jake was relatively intrigued with the racing games in the Cars 2 ultra ebook. Getting accustomed to using the accelerometer to race took time, but once he mastered it, he loved playing the games over and over again. He didn't have as much interest in the actual book, but that maybe because his reading skills are more advanced. That wasn't the case with his 3-year-old brother Matt. Matt was very taken with the read-aloud function, and spent a lot of time just listening to the book being read aloud to him. He was also very taken with the Pet Pad app that came with the device. He thought it was very funny that blowing into the microphone could help dry his pet. Both Jake and Matt had fun with the built-in camera and video recorder, and they loved playing their videos back on the device.

It's important to keep in mind that the LeapPad is toy, and not an actual tablet. In contrast, the Vinci Tab ($389 list, 2.5 stars) is an actual Android-based tablet that's targeted toward children. The Tab is certainly more expensive than the LeapPad, but it also has higher-end components, and the android-based game apps are cheaper than the $24.99 gaming cartridges or the $5 and up gaming, movie, and book apps you would shell out for the LeapPad. But the LeapPad offers a bulletproof kids' experience right out of the box, with minimal setup and no support necessary.

The LeapPad's design and interface are appropriate for Jake's age, and it's colorful and advanced enough to hold his interest. It was also something that his younger brother enjoyed playing with. So, I consider it a two-for-one win. I wish LeapFrog had put in some sort of media card slot. That way, we could maybe keep more apps and games than the system's of onboard memory allows. But then again, 2GB of memory is pretty big. I also hope LeapFrog comes out with a recharger, because, seriously, I'm keeping Duracell in business. Overall, the LeapFrog LeapPad Explorer is my?and more important, Jake's?favorite LeapFrog product yet. It takes the concept of a tablet and makes it an attractive learning toy for the kid crowd.

5 Polish troops killed in east Afghanistan (AP)

KABUL, Afghanistan ? Five Polish soldiers were killed Wednesday when a roadside bomb exploded in eastern Afghanistan, the alliance and a Polish official said.

It was the deadliest single attack for the Polish military in Afghanistan, spokesman Jacek Sonta said in Warsaw. He said the soldiers were in a convoy headed to Rawza, in eastern Ghazni province, when it struck the bomb.

The Taliban immediately claimed responsibility for the attack in a text message to journalists. Taliban spokesman Zabiullah Mujahid said "a Polish tank" was blown up and all its occupants were killed.

Mohamad Ali Ahmadi, deputy governor of Ghazni province, said that Polish soldiers were attending a morning meeting in the Rawza district of Ghazni city, about 77 miles (125 kilometers) southwest of the capital Kabul. One of their vehicles was destroyed by a roadside bomb, he said.

Poland is in the process of withdrawing some 100 out of the 2,600 troops it has in Afghanistan.

So far this year, 532 NATO service members have been killed in Afghanistan. The attack on the Polish convoy brings the number of NATO troops killed in December to 16.

Also in the east, Afghan police said they shot dead on Wednesday a would-be suicide bomber before he was able to attack a police station.

Youqib Khan, deputy police chief in Khost province, said policemen identified the would-be bomber in front of a bank next to the police station in Khost city and killed him before he could detonate his explosives vest. A search operation was under way because police fear the attacker, who was wearing a vest packed with explosives, might not have been working alone, he said.

Meanwhile, an Afghan military spokesman said the country's armed forces now number 180,000 troops, a significant step toward having enough troops to replace departing coalition forces.

Defense Ministry spokesman Mohammad Zahir Azimi said the troop numbers increased by more than 40,000 in 2011. This brings the military closer to the goal of having 195,000 Afghan troops by next October.

"Once we achieve that, then we will start discussing an agreement with international community to expand to 240,000 soldiers," Azimi said. "And once we have reached that, the Afghan National Army will be able to take control of internal and external security in all of Afghanistan."

The expansion of the army and police is a critical element in NATO's exit strategy from Afghanistan.

Coalition forces, which started their drawdown this year, are already handing over responsibility for security to the Afghan army and police in selected regions. The process will run through 2014 when international forces are to end their combat role.

But Azimi noted that troops are continuing to leave the Afghan military and that the attrition rate remains high, at about two percent per month. This makes it necessary to recruit and train large numbers of men just to keep up the army's strength levels.

Attrition includes all service members leaving the security forces, including those who have completed their terms of service or left due to medical or other reasons, losses in combat and desertions.

Critics have said some of the men deserting the security forces ? often with their weapons ? are defecting to the Taliban and providing the insurgents with trained new fighters.

Azimi attributed the losses mainly to the problems the men face when they are based far from their homes and families in regions in the east and south where the insurgency has been the most active.

Iran says oil would go over $250 if exports banned (Reuters)

TEHRAN (Reuters) ? Iran warned the West on Sunday any move to block its oil exports would more than double crude prices with devastating consequences on a fragile global economy.

"As soon as such an issue is raised seriously the oil price would soar to above $250 a barrel," Foreign Ministry spokesman Ramin Mehmanparast said in a newspaper interview.

The comments come as Iran strives to contain international reaction to the storming of the British embassy last week, a move which drew immediate condemnation from around the world and may galvanize support for tougher action against Tehran.

Washington and EU countries were already discussing measures to restrict oil exports after the United Nations nuclear watchdog issued a report in November with what it said was evidence that Tehran had worked on designing an atom bomb.

Iran says its nuclear program is entirely peaceful.

The U.S. Senate voted on Thursday to penalize foreign financial institutions that do business with Iran's central bank

-- which takes payment for the 2.6 million barrels Iran exports a day. The European Union is considering a ban -- already in place in the United States -- on Iranian oil imports.

So far neither Washington nor Brussels has finalized its move against the oil trade or the central bank amid fears of the possible impact on the global economy of restricting oil flows from the world's fifth biggest exporter.

But the British embassy attack dragged relations with Europe to a long-time low and Iran is now facing rising rhetoric about a direct hit on its main source of foreign earnings.

Until recently, Iran had dismissed as ineffective mounting sanctions aimed at forcing it to halt its nuclear activities. Mehmanparast's comments show a more defensive stance.

"No one welcomes the sanctions, we know that sanctions create obstacles, but we want to say we will overcome these obstacles," Mehmanparast told Sharq daily.

"Imposing sanctions on oil and gas is among the sanctions that, if one wants to do that, the consequences should be fully considered before taking any action," Mehmanparast said.

"I do not think the situation in the world and especially in the West today is prepared enough to raise such discussions."

Britain's embassy in Tehran was ransacked on Tuesday after London announced unilateral sanctions on Iran's central bank. London evacuated staff, closed the embassy and the biggest EU states withdrew their ambassadors in protests.

Rising tensions were enough to push up crude prices with ICE Brent January crude up 95 cents on Friday to settle at $109.94 a barrel.

Mehmanparast warned the EU on Saturday to avoid tying itself to British interests.

(AP Photo/File)

WASHINGTON (AP) ? Lawmakers, responding to pleas from industry and foreign governments, have tentatively agreed to block the Obama administration from requiring that air shipments of lithium batteries be treated as hazardous cargo because of the danger of fires during flight.

The deal came in talks on a long-term funding bill for the Federal Aviation Administration, Rep. Nick Rahall, D-W.Va., told The Associated Press. The bill will effectively block new battery-shipment rules by insisting the U.S. follow international standards, which are less stringent, said Rahall, top Democrat on the House Transportation and Infrastructure Committee.

Pilot unions said the international standards don't provide enough safety and are weaker than rules the administration proposed nearly two years ago but never made final. The unions and the National Transportation Safety Board for several years have sought new rules on air shipments of the batteries to prevent fires that can cause air crashes and deaths.

"We're very concerned that unless this issue is addressed we'll continue to see accidents and we'll continue to see fatalities," said Mark Rogers, who heads the Air Line Pilots Association's committee on hazardous cargo.

The U.S. shouldn't "adopt an existing international standard on lithium batteries that's generally recognized as inadequate," Robert Travis, president of Independent Pilots Association, which represents UPS pilots, said in a statement.

The FAA bill "is an opportunity for the U.S. to lead by setting a higher standard on the carriage of lithium batteries," Travis said.

A fire broke out five years ago in cargo containing lithium batteries and other goods on a United Parcel Service plane, forcing an emergency landing in Philadelphia. No one was killed, but one of the pilots said he was able to escape with seconds to spare. The cause of the fire wasn't conclusively determined, but batteries were suspected.

Last year, another UPS plane with a fire raging on board, and carrying thousands of lithium batteries, crashed near Dubai in the United Arab Emirates, killing both pilots. The accident is still under investigation, but preliminary reports indicate investigators have focused much of their attention on the batteries.

The use of rechargeable lithium-ion and non-rechargeable lithium-metal batteries has soared since the late 1990s. Millions of products from laptops to cellphones to watches contain the batteries. And, in an age of increasing globalization of trade, those products are often shipped by air to and from the United States and other countries.

But the batteries can catch fire if they are damaged, exposed to high temperatures or packaged incorrectly. Lithium-ion battery fires can reach 1,100 degrees, close to the melting point of aluminum, a key material in airplane construction. Lithium-metal battery fires are far hotter, capable of reaching 4,000 degrees.

The administration proposed regulations that would have threated lithium batteries and goods containing the batteries as hazardous materials requiring special labeling and training of workers who package and handle them.

But they were opposed by a broad swath of powerful industries, including battery-makers, electronics manufacturers and retailers, cargo airlines, and at least a half dozen foreign governments who said they would disrupt international trade. The opponents said the regulations would cost them hundreds of millions of dollars in added packaging, paperwork and employee training. The rechargeable battery industry alone says the rules would cost more than $1 billion in the first year.

Opponents of the proposed rules turned for help to Congress, where House Republicans passed an FAA funding bill that requires the U.S. to follow standards set by the International Civil Aviation Organization, a UN agency, effectively blocking the rules. The Senate did not include the measure in its version of the funding bill, but under the tentative deal reached Friday, the House-Senate compromise bill would include it.

Kara Ross, a spokeswoman for United Parcel Service, said the cargo carrier wasn't aware of the agreement reached by lawmakers but supports the House provision.

A spokesman for PRBA-The Rechargeable Battery Association declined to comment.

Besides Rahall, the other lawmakers involved in negotiations were Rep. John Mica, chairman of the House committee, Sen. Jay Rockefeller, D-W.Va., and Kay Bailey Hutchison, senior Republican member of the Senate committee.

Afghan president pardons imprisoned rape victim (AP)

KABUL, Afghanistan ? Afghan President Hamid Karzai on Thursday pardoned an Afghan woman serving a 12-year prison sentence for having sex out of wedlock after she was raped by a relative.

Karzai's office said in a statement that the woman and her attacker have agreed to marry. That would reverse an earlier decision by the 19-year-old woman, who had previously refused a judge's offer of freedom if she agreed to marry the rapist.

Her plight was highlighted in a documentary that the European Union blocked because it feared the women featured in the film would be in danger if it were shown.

More than 5,000 people recently signed a petition urging Karzai to release the woman. She had the man's child while in prison and raised her daughter behind bars, which is common among women imprisoned in Afghanistan.

A statement released by Karzai's office says that after hearing from judicial officials, the decision was made to forgive the rest of the sentence she received for having sex out of wedlock, a crime in Afghanistan. The presidential statement did not say when the woman was to be released or how much prison time had been pardoned.

The woman told The Associated Press in an interview last month that she had hoped that attention generated by the EU film might help her get released. With the film blocked, she said that she was losing hope and considering marrying her rapist as a way out. She said her attacker was pressuring her to stop giving interviews.

About half of the 300 to 400 women jailed in Afghanistan are imprisoned for so-called "moral crimes" such as sex outside marriage, or running away from their husbands, according to reports by the United Nations and research organizations. Fleeing husbands isn't considered a crime in Afghanistan.

The EU welcomed the woman's release.

"Her case has served to highlight the plight of Afghan women, who 10 years after the overthrow of the Taliban regime often continue to suffer in unimaginable conditions, deprived of even the most basic human rights," the European Union's Ambassador and Special Representative to Afghanistan, Vygaudas Usackas, said.

He said the EU hoped the same mercy would be extended to other women serving similar terms. Usackas said he planned to raise the issue of Afghan women's rights at an international conference on Afghanistan Dec. 5 in Bonn, Germany.

Some of the most severe restrictions women faced under the Taliban, like a ban on attending schools and having to have a male escort to venture outside the home, were done away with when the radical Islamic movement was driven from power in 2001. But Afghanistan remains a deeply conservative and male-dominated society, meaning women are still sold to husbands and rights enshrined in law are often ignored in practice.

Mindy McCready, son reported missing in Florida (AP)

TAMPA, Fla. ? Florida authorities say country singer Mindy McCready is missing with her 5-year-old son, and a judge has given her until Thursday to return the boy.

The state Department of Children and Families says a missing persons report was filed with Cape Coral police Tuesday night after McCready took her son Zander from her father's home.

McCready doesn't have custody of her son ? her mother does ? and the singer was allowed to visit the boy at her father's home, according to a department spokesman. On Tuesday, DCF discovered that McCready and the boy were not at her father's home.

DCF spokesman Terry Field told The Associated Press the agency asked a Lee County judge for an emergency pickup order, and the judge ruled McCready must return the boy voluntarily by 5 p.m. Thursday or risk an arrest warrant.

Cape Coral Police Lt. Tony Sizemore said that so far, there's "no criminal act."

"There's a lot more questions than answers at this point," he said.

Cape Coral is on Florida's Gulf coast, about 120 miles northwest of Miami.

The singer's brother, Josh McCready, told The Associated Press in a private Facebook message that his sister was "fine."

"Mindy is fine and so is Zander. There is nothing to worry about," he wrote.

Since topping the country charts in the mid-1990s with her music, the troubled 36-year-old singer's life has been filled with domestic abuse, drug and DUI arrests and a suicide attempt. In August, she filed a libel suit in Palm Beach County against her own mother and the National Enquirer's parent company, American Media Inc., over a story published in the tabloid newspaper that quoted her mother.

In 2010, she spoke with The Associated Press about her life.

"It is a giant whirlwind of chaos all the time," she said. "I call my life a beautiful mess and organized chaos. It's just always been like that. My entire life, things have been attracted to me and vice versa that turn into chaotic nightmares or I create the chaos myself. I think that's really the life of a celebrity, of a big, huge, giant personality."

In July 2007, she was accused of scuffling with her mother and resisting arrest at her mother's home in Florida. She was sentenced to jail for 60 days for a probation violation and released; she served 30 days in jail. She also lost custody of her son.

And in 2008, McCready was admitted to a Nashville hospital after police said she cut her wrists and took several pills in a suicide attempt.

During the TV show "Celebrity Rehab 3" in 2010 McCready came off as a sympathetic figure, and host Dr. Drew Pinsky called her an angel in the season finale.

On the show she said she suffered from love addiction, not substance abuse. In one of the show's scarier moments, McCready suffered a seizure and was rushed to a hospital where scans showed brain damage.

Also in 2010, police went to McCready's mother's home for a report of an overdose, and McCready was taken to a Florida hospital. However, neither the hospital nor McCready's publicist would say why McCready was hospitalized.

McCready also fought the release of a tape in which she reportedly talked about former Boston Red Sox and New York Yankees pitcher Roger Clemens, with whom she had an affair as a teenager.

A call to a lawyer representing McCready in the custody case was not immediately returned.
